End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Eric Lagarda ("Licensor") for the use of the Nett iOS application ("App"). By downloading or using the App, you agree to be bound by this EULA. This EULA incorporates Apple's standard EULA terms available at apple.com/legal/internet-services/itunes/dev/stdeula/.

1. License grant

Subject to the terms of this EULA, the Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on any Apple-branded device that you own or control, solely for your own personal and professional use.

2. Restrictions

You may not: copy, modify, or distribute the App or any of its content; reverse-engineer, decompile, or disassemble the App; rent, lease, lend, sell, or sublicense the App; use the App for any commercial purpose without prior written consent; or remove or alter any proprietary notices or labels on the App.

3. Intellectual property

The App and all content, features, and functionality are owned by Eric Lagarda and are protected by copyright, trademark, and other intellectual property laws. This EULA does not transfer any ownership rights to you.

4. Subscriptions

The App offers in-app purchases for premium features. Subscriptions are managed through Apple's App Store. You authorise Apple to charge your Apple ID account for the applicable subscription fee. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date through your Apple ID settings.

5. No warranty

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Licensor does not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.

6. Tax and financial disclaimer

The App provides tax estimates and financial calculations for informational purposes only. These are not professional tax advice. The Licensor is not a licensed tax advisor or financial institution. Always consult a qualified professional for your specific tax situation. The Licensor is not liable for any tax underpayments, penalties, or financial losses arising from your use of the App's calculations.

7. Limitation of liability

To the maximum extent permitted by applicable law, the Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. The Licensor's total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

8. Maintenance and support

The Licensor is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services with respect to the App. For support, contact [email protected].

9. Product claims

The Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to applicable legal or regulatory requirements; and (iii) claims arising under consumer protection, privacy, or similar legislation.

10. Third-party beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

11. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

12. Governing law

This EULA is governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain, unless mandatory consumer protection laws in your country of residence provide otherwise.
